National Defense Authorization Act for Fiscal Year 2024 This bill authorizes FY2024 appropriations and sets forth policies for Department of Defense (DOD) programs and activities, military construction, the national security programs of the Department of Energy (DOE), and the Maritime Administration. It also authorizes appropriations for the Defense Nuclear Safety Board and the Naval Petroleum Reserves. The bill authorizes appropriations but it does not provide budget authority, which is provided by appropriations legislation. DIVISION A--DEPARTMENT OF DEFENSE AUTHORIZATIONS TITLE I--PROCUREMENT This title authorizes appropriations for acquiring or modifying various military items (such as aircraft, ships, tracked combat vehicles, missiles, and ammunition) and sets policy for certain procurement programs. Below are some examples of provisions in this title. Sec. 131 authorizes the Navy to enter into multiyear procurement contracts for up to 13 Virginia class submarines (nuclear-powered attack submarines), as well as advance procurement contracts (i.e., contracts to procure components needed for an item long before the item itself  is purchased) for equipment and subsystems associated with the Virginia class submarine program. Sec. 157 prohibits the use of funds made available to the Air Force for FY2024 from being used to reduce the number of certain KC-135 aerial refueling aircraft within the Air Force's reserve components. Sec. 158 prohibits the use of funds made available to the Air Force for FY2024 from being used to terminate a production line for HH-60W combat rescue helicopters. Sec. 181 authorizes DOD to enter into multiyear procurement contracts for rare earth elements (generally, a group of elements used in many products, such as rechargeable batteries and defense applications) that are processed in the United States by qualified domestic sources, and to enter into related advance procurement contacts. TITLE II--RESEARCH, DEVELOPMENT, TEST, AND EVALUATION This title authorizes appropriations for research, development, test, and evaluation (RDT&E) and sets policy for certain RDT&E activities, such as additive manufacturing (also known as 3D printing), artificial intelligence, and quantum computing. Below are some examples of provisions in this title. Sec. 214 requires DOD to establish certain disclosure requirements for applicants and recipients of DOD research funding conducted by an institution of higher education (IHE). The disclosures must include the researchers' date and place of birth, country of citizenship, educational background, employment background, and affiliations with foreign governments.  Sec. 220 requires DOD to implement a process to assess whether an artificial intelligence (AI) technology used by DOD is functioning responsibly and report and address instances where the technology is not functioning responsibly, including by discontinuing its use if necessary. Sec. 222 establishes a pilot program to enable organizations within DOD to test and evaluate how quantum and quantum-hybrid applications may be used to solve technical challenges and provide needed capabilities. Fiscal Responsibility Act of 2023 This bill increases the federal debt limit, establishes new discretionary spending limits, rescinds unobligated funds, and expands work requirements for federal programs. Specifically, the bill suspends the federal debt limit through January 1, 2025, and increases the limit on January 2, 2025, to accommodate the obligations issued during the suspension period. In addition, the bill establishes new discretionary spending limits for FY2024 and FY2025 that are enforced with sequestration (i.e., automatic spending cuts). It also changes the limits to 1% below the FY2023 base funding levels if a continuing resolution is in effect on or after January 1, 2024, or on or after January 1, 2025, because all 12 regular appropriations bills were not enacted by the end of the prior year. The bill also includes provisions that * rescind certain unobligated funds that were provided to address COVID-19 and to the Internal Revenue Service; * provide funding for the Department of Veterans Affairs Cost of War Toxic Exposure Fund; * provide funding for the Department of Commerce Nonrecurring Expenses Fund; * provide statutory authority through 2024 for the requirement for agencies that propose certain administrative actions that will increase direct spending to also propose at least one administrative action that will decrease direct spending by at least the same amount (commonly known as administrative pay-as-you-go rules); * terminate the suspension of federal student loan payments; * expand the work requirements for the Supplemental Nutrition Assistance Program (SNAP) and the Temporary Assistance for Needy Families (TANF) program; and * expedite the permitting process for certain energy projects.

TITLE I--DEPARTMENT OF DEFENSE This title provides appropriations to the Department of Defense (DOD) for Military Construction for * the Army; * the Navy and Marine Corps; * the Air Force; * Defense-Wide agencies and activities (other than military departments); * the Army and Air National Guard; and * the Army, Navy, and Air Force Reserves. The title also provides appropriations to DOD for the (1) North Atlantic Treaty Organization (NATO) Security Investment Program, and (2) the DOD Base Closure Account. The title provides appropriations to DOD for Construction and Operation and Maintenance of Family Housing for * the Army, * the Navy and Marine Corps, * the Air Force, and * Defense-Wide agencies and activities (other than military departments). The title provides appropriations to DOD for (1) the Family Housing Improvement Fund, and (2) the Military Unaccompanied Housing Improvement Fund. (Sec. 101) This section prohibits funds provided by this title from being used for payments exceeding $25,000 under a cost-plus-a-fixed-fee contract for construction in the United States without a specific DOD approval in writing. The section includes an exception for work that is to be performed in Alaska. (Sec. 102) This section permits construction funds provided by this title to be used for hiring passenger motor vehicles. (Sec. 103) This section permits construction funds provided by this title to be used for advances to the Federal Highway Administration for the construction of access roads DOD has certified as important to national defense. (Sec. 104) This section prohibits funds provided by this title from being used to begin construction of new bases in the United States without a specific appropriation. (Sec. 105) This section prohibits funds provided by this title from being used to purchase land or land easements in excess of 100% of the value as determined by the Army Corps of Engineers or the Naval Facilities Engineering Command. The section includes exceptions for (1) determinations of value by a federal court, (2) purchases negotiated by the Department of Justice, (3) values less than $25,000, and (4) purchases that are otherwise determined by DOD to be in the public interest. (Sec. 106) This section prohibits funds provided by this title from being used to acquire land, provide for site preparation, or install utilities for family housing, except housing for which appropriations have been provided. (Sec. 107) This section prohibits funds provided by this title for minor construction from being used to transfer or relocate any activity from one base or installation to another without notifying Congress in advance. (Sec. 108) This section prohibits funds provided by this title from being used to procure steel for construction unless American producers, fabricators, and manufacturers have been allowed to compete for the procurement. (Sec. 109) This section prohibits funds provided to DOD for military construction or family housing during the current fiscal year from being used to pay real property taxes in any foreign nation. (Sec. 110) This section prohibits funds provided by this title from being used to initiate a new installation overseas without notifying Congress in advance. Extension of Continuing Appropriations and Other Matters Act, 2024 This bill provides continuing FY2024 appropriations for federal agencies, modifies the requirements for determining eligibility for federal student aid, and provides additional funding for Federal Pell Grants. The bill is known as a continuing resolution (CR) and prevents a government shutdown that would otherwise occur if the FY2024 appropriations bills have not been enacted when the existing CR expires. The CR provides funding through March 8, 2024, for agencies and programs that were funded in the following four FY2023 appropriations acts: the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2023; the Energy and Water Development and Related Agencies Appropriations Act, 2023; the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2023; and the Transportation, Housing and Urban Development, and Related Agencies Appropriations Act, 2023. For most other federal agencies and programs, the CR provides funding through March 22, 2024. (Under the current CR, the first group of agencies is funded through March 1, 2024, and the remaining agencies are funded through March 8, 2024.) The CR generally funds most programs and activities at the FY2023 levels with several exceptions that provide funding flexibility and additional appropriations for various programs. The bill also revises the computation of the student aid index (SAI) for dependent students, which is used to determine eligibility for federal student aid. The SAI for a dependent student is calculated using the Free Application for Federal Student Aid (FAFSA) data for the student and their parents. The FAFSA Processing System calculates the parents' contribution from income and assets, the student's contribution from income, and the student's contribution from assets; the SAI is the sum of these three values. In particular, the bill specifies that a student's available income shall not be less than -$1,500 for award year 2024-2025 and not less than $0 for award year 2025-2026 and each succeeding award year. The bill also provides specified additional funds for Federal Pell Grants for FY2025 and each succeeding fiscal year.

Commitment to Veteran Support and Outreach Act This bill authorizes the Department of Veterans Affairs (VA) to provide grants to states to implement programs that improve outreach and assistance to veterans and their families to ensure that such individuals are fully informed about veterans' benefits and programs. Specifically, the VA may provide grants to states to (1) implement or enhance outreach activities or activities to assist in the development and submittal of claims for veterans, or (2) increase the number of county or tribal veterans service officers in the state. The VA must prioritize awarding grants in areas with a critical shortage of county or tribal veterans service officers, areas with high rates of suicide among veterans, and areas with high rates of referrals to the Veterans Crisis Line.

This bill addresses Department of Veterans Affairs (VA) benefits and care for certain children with spina bifida or other birth defects. The bill requires the VA to provide health care, job training, and monetary benefits for the duration of the child's life. The bills covers a child, regardless of age or marital status, who: (1) has spina bifida and is the natural child of a Vietnam veteran or a veteran of specified service in Korea or Thailand who was conceived after the date on which the veteran entered service in Vietnam, Korea, or Thailand; or (2) has certain birth defects and is the natural child of a woman Vietnam veteran. The bill requires the VA to establish an advisory council on health care and benefits for covered children. Additionally, the VA must establish care and coordination teams for covered children. At least every 180 days, the teams must conduct outreach to ensure the continued care of the children and assist with any necessary changes in care. The VA must report to Congress a list of conditions that will trigger outreach to covered children, and must attempt to contact such children as soon as practicable after the identification of a condition. The Veterans Benefits Administration and the Veterans Health Administration must enter into a memorandum of understanding to better assist covered children.

Eliminating Abusive and Rampant Neglect of Interactive Technologies Act of 2023 or the EARN IT Act of 2023 This bill revises the federal framework governing the prevention of online sexual exploitation of children. The bill establishes the National Commission on Online Child Sexual Exploitation Prevention. The commission must develop best practices for interactive computer services providers (e.g., Facebook and Twitter) to prevent, reduce, and respond to the online sexual exploitation of children. Additionally, the bill limits the liability protections of interactive computer service providers with respect to claims alleging violations of child sexual exploitation laws. The bill replaces various statutory references to child pornography and material that contains child pornography with child sexual abuse material. Finally, the bill makes changes to the reporting requirements for electronic communication service providers and remote computing service providers (providers) who report apparent instances of crimes involving the sexual exploitation of children to the National Center for Missing and Exploited Children. Among the changes, the bill requires providers to report facts and circumstances sufficient to identify and locate each minor and each involved individual. The bill also increases the amount of time that providers must preserve the contents of a report.
