Davenport man accused of sexually abusing child for nine years

Apr. 6—A Davenport man is facing multiple sex abuse charges after police said he sexually abused a child multiple times for about nine years beginning when the victim was 5 years old.

Adan Diaz-Herrera, 51, was arrested Thursday in Rock Island County and waived extradition to Iowa on Friday.

He is charged in Scott County District Court with three counts of second-degree sexual abuse, each of which is a Class B felony under Iowa law that carries a prison sentence of 25 years.

Diaz-Herrera also is charged with three counts of lascivious acts with a child, a Class C felony that carries a prison sentence of 10 years, and one count each of assault with the intent to commit sexual abuse, an aggravated misdemeanor that carries a prison sentence of two years, and indecent exposure, a serious misdemeanor that carries a jail sentence of up to one year.

According to the arrest affidavit filed by Davenport Police Detective A.J. Poirier, the investigation into the allegations made against Diaz-Herrera began Jan. 19.

Police determined through the investigation that the victim was abused multiple times when the victim was between the ages of 5 and 14. The victim was able to describe the abuse to detectives in detail. Diaz-Herrera tackled and restrained the victim in order to commit sexual abuse when the victim was 14, according to the affidavit.

During a first appearance hearing on the charges held Saturday in Scott County District Court, Magistrate Jay Sommers scheduled a preliminary hearing for April 16.

Diaz-Herrera was being held Saturday in the Scott County Jail on a cash-only bond of $100,000 that was set by Sommers.
